Terms of Service

Scope

These Terms govern your use of Fortiview Holdings’ services, including PragOptics™ system integration and related offerings. By accessing or using our services, you agree to these Terms.

Eligibility

You must be at least 18 years old and legally able to enter into contracts to use our services.

Service Agreement

We will provide services with reasonable skill, care, and in good faith. You agree to provide accurate information, maintain necessary access, and use our services only for lawful purposes.

Acceptable Use

You may not misuse our systems, attempt unauthorized access, or interfere with service integrity.

Termination

Either party may terminate services with written notice if the other materially breaches these Terms and fails to cure within 30 days. We may suspend or terminate immediately for unlawful use or security risks.

Liability

We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees paid for the services in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Contact details, account and billing information, and technical data such as IP address and usage logs.

How We Use Information

To provide and improve services, communicate with you, and comply with legal obligations.

Sharing

We do not sell your data. We may share with trusted service providers under confidentiality agreements.

We retain data only as long as necessary for service delivery, legal compliance, or legitimate business purposes.

Your Rights

You may request access, correction, or deletion of your personal data, subject to applicable law.

Client Communications

We may contact you via email, SMS, or phone for service updates, billing, and support. Marketing communications require your opt‑in consent and include an unsubscribe option. You are responsible for keeping your contact information current.

Cookies & Tracking

We use cookies and similar technologies to manage sessions, analyze site usage, and improve user experience. You may disable cookies in your browser, but some features may not function properly.

Data Security

We implement administrative, technical, and physical safeguards to protect your data. While no system is 100% secure, we take reasonable measures to prevent unauthorized access, disclosure, or loss. You are responsible for maintaining the confidentiality of your account credentials. We will notify you of any data breach as required by law.

Your rights: Access to services as agreed, data protection rights, and the ability to terminate under these Terms.

Our rights: To update services, enforce policies, and protect system integrity.

Mutual good faith: Both parties agree to act honestly, fairly, and in good faith in all dealings.

Pricing Philosophy

One-Time Setup Fee

Our advertised setup fee includes foundational infrastructure and is delivered regardless of usage. This covers:

  • ✅ One full webpage with a singular automation aligned to the selected service tier
  • ✅ Additional infrastructure and backend setup not billed ad-hoc
  • ✅ No surprise billing - setup is inclusive and transparent

Additional Web Pages

Clients may request additional functional pages beyond the included setup. Pricing:

  • 💬 Informational-only pages: $250 minimum per page
  • ⚙️ Pages requiring automation (e.g. eCommerce, dynamic forms): priced based on integration complexity

Integration development is billed at $125.00/hour, only after initial setup completion and only for requested services.

Tiered Service Model

Our four-tier system is designed for accessibility, modular growth, and operational transparency:

  • Email Essentials – a value-added, hassle-free entry point with branded email, backend support, and SharePoint access
  • Productivity Suite – includes Office apps, Teams, and advanced SharePoint features for collaborative work
  • Automation Builder – adds PowerApps Developer and Power Automate Premium licensing, enabling custom automation and app development
  • Super User Suite – includes all previous tiers plus MS Agent access, Fortiview workflow sharing, and personalized training for high-impact operators

All tiers are priced per user and can be upgraded at any time. Licensing is included, billing is transparent, and each tier is built to scale with your needs.
